Item 6 -           Final Plat and Plans – The Pavilion at Port Orange

 

On October 25, 2007, the Planning Commission recommended approval 5-0 (Commissioners Lasky and Atwood excused) to approve the Preliminary and Final Plat and Plans for The Pavilion at Port Orange commercial subdivision.  The subject property is approximately 73.1 acres in size, located in the northwest quadrant of the City, on the west side of I-95, east of S. Williamson Boulevard, north of Taylor Road and south of Town West Boulevard,  if approved, the owner intends to subdivide the property into eleven lots and develop it as a 550,000 square foot open air “lifestyle center” consisting of department stores, retail shops, restaurants, offices, a movie theater, and outdoor amenities, such as  a central park area, children’s playground, and pedestrian plazas.  The Planning Commission’s recommendation for approval is subject to resolution of the two outstanding comments referenced in the attached staff report.

 

At the time of the writing of the staff report, there were two outstanding technical comments regarding the SIA.  Since then, the applicant has revised the SIA; and as of December 4, 2007, there are no outstanding technical comments remaining.

 

Staff recommends that Council approve the Preliminary and Final Plat and Plans for The Pavilion at Port Orange and to approve the Subdivision Improvement Agreement for this project, subject to review and approval of the DRI Development Order, approval of the Master Development Agreement, and Conceptual Development Plan, and review by the City Attorney as to legal form and content.

 

Item 7 -           Site Plan – The Pavilion at Port Orange

 

On November 15, 2007, the Planning Commission recommended approval 5-0 (Commissioners Lasky excused; one position vacant) to approve the Final Site Plan for Lot 5 of The Pavilion at Port Orange Planned Commercial Development.  The property is approximately 73.1 acres in size, located in the northwest quadrant of the City, on the west side of I-95, east of S. Williamson Boulevard, north of Taylor Road, and south of Town West Boulevard.  If approved, the owner intends to develop the property as an open air “lifestyle center” consisting of department stores, retail shops, restaurants, offices, a movie theater, and outdoor amenities, such as a central park area, children’s playground, and pedestrian plazas.  The subject site plan for Lot 5, the larger shopping center lot, includes approximately 475,174 square feet of development (392,305 square feet of retail; 37,945 square feet of office; and a 44,924 square foot theater).

 

The Planning Commission’s recommendation for approval is subject to the conditions outlined in the attached staff report.  At the time of the writing of the staff report, there were three outstanding technical comments.  Since then, the applicant has provided staff with select elevation sheets revised to address technical comments.  Staff has reviewed the information provided; and as of December 6, 2007, there are no outstanding technical comments remaining.

 

Staff recommends that Council approve the Final Site Plan for The Pavilion at Port Orange, as recommended by the Planning Commission, subject to review and approval of the DRI Development Order, approval of the Master Development Agreement, and Conceptual Development Plan, and review by the City Attorney as to legal form and content.

 

Item 8 -           Concurrency and Fair Share Agreement – Halifax Veterinary Clinic

 

We have been working with Halifax Veterinary Clinic on their concurrency and fair share agreement.  They have requested to pay a fair share payment while they are awaiting the outcome of an independent traffic study.  As the City Council is aware, there is no classification for Veterinary Clinics in the manual that is used as a guide to determine trip rates.  The trip rate that is commonly assigned to Veterinary Clinics is medical offices, which is a higher trip generation rate than what normally would be anticipated in the Veterinary Clinic. 

 

Currently, there are two Veterinary Clinic expansions being discussed with staff.  An independent trip generation study is being done, and the results of the study will assist staff in assigning the appropriate trip rates.  This may result in the City refunding a portion of the fair share payments should the trip rates generate a lower amount.  This will allow the owners of Halifax Veterinary Clinic to proceed to construction on their project to be located on Dunlawton Avenue.
