Attached is the Submitter License Agreement with Simplifile for e-recording documents through the Volusia County Clerk of Court.
Staff believes this service will be beneficial to expedite the recording of certain documents. There is an additional fee of $2.00 per document that will be paid by the applicant. Annual costs are estimated at $2,000.00
Staff recommends authorization to enter into the Submitter License Agreement with Simplifile for e-recording through the Volusia County Clerk of Court.
In 1984, the City of Port Orange entered into an agreement with the County of Volusia to provide fire suppression and rescue services to the unincorporated areas in the southeast quadrant of the City. The City of Port Orange shall receive payment of $ 7,140.00 per month for the duration of this contract. The prior agreement approved by City Council ran from October 1, 2012 and expired on February 28, 2013. Since the time expired on the contract, the City and County have come to an agreement to extend a First Amendment for contractual deadline to September 30, 2013.
Staff recommends approval of the extended First Amendment contract between the County of Volusia and City of Port Orange from February 28, 2013 to the agreed upon date of expiration, September 30, 2013, to provide fire suppression and rescue services to certain unincorporated areas of the County.
On January 5, 2010 the City council approved the R.F.P. award #10-02 for the City’s General Banking Services. The contract effective date was October 1, 2010 with an initial term of three (3) years with up to 2 two (2) year renewal options, if mutually agreeable to both parties.
City staff has expressed the desire to exercise the first two(2) year renewal option. Sun Trust has agreed, in writing, to the extension. Sun Trust has agreed to guarantee an Earnings Credit rate (ECR) of .65% and a Municipal Now interest rate of .23% for the first year of the contract extension. Also Sun Trust has agreed to an ECR of .60% for the second year of the extension with a Municipal Now Rate at a competitive market rate. Staff has compared the offered rates with the current market rates and has found them to be competitive.
Staff recommends approval of the two (2) year extension of the existing contract with the amended terms detailed in the attached letter of agreement dated March 11, 2013. Please see the attachments for the specific detail.
The Port Orange Police Department is requesting to sign an agreement with Network Environmental Systems, Inc. to present Clandestine Laboratory Safety Certification Training satisfying the OSHA Hazardous Waste Operations and Emergency Response Standard and U.S. DEA certification requirements. The class size will be limited to 40 students and will be offered to agencies throughout the area. Forfeiture funds will be used to pay the approximate cost of $23,777.50. A tuition fee will be charged for outside agencies to attend. A copy of the agreement is attached.
Staff recommends authorizing the Director of Public Safety to sign an agreement to host a Clandestine Laboratory Safety Certification and Site Safety Officer Class at the Port Orange Police Department.
The purpose of this Memorandum of Understanding is to establish the terms and conditions under which the Florida Department of Law Enforcement and the Port Orange Police Department will agree to jointly assume with FDLE, the obligations set forth in the Memorandum of Understanding in order to participate in the DEA Central Storage Program. The MOU will be effective upon execution until March 29, 2015. A copy of the Memorandum of Understanding is attached.
Staff recommends authorizing the Director of Public Safety to sign the Memorandum of Understanding for participation in the Methamphetamine Clandestine Drug Laboratory Hazardous Waste Central Storage Container Program.

F. CITY ATTORNEY (Margaret Roberts)
The City Council asked that the Agenda format include an agenda item that would allow the City Attorney to report and update City Council members.
G. ADMINISTRATION (GREG KISELA)
The City seeks assistance from the FIND grant program to design and permit and prepare bid documents for a kayak/canoe launch facility and boardwalk in Town Center Riverwalk, north and south of the Riverside Pavilion. The boardwalk will connect to the existing fishing pier north of the pavilion (see map). Currently, staff is discussing the project’s design with the Riverside Pavilion.
The project costs associated with this project total $80,000.00. The City is requesting $40,000.00 from the FIND program and matches the request with $40,000.00 in cash.
The FIND program specifically requires the attached Resolution (Attachment E-6) and its related language be approved. Project No.:AIO004 Funding Account No.: 307-1000-552-63-97.
Staff recommends approving Resolution 13 – 17 authorizing the City Manager to submit a grant application to the Florida Inland Navigation District (FIND) grant program, provide a match, and authorizing the Mayor and City Clerk to execute any agreements or contracts.
This has been placed on the agenda so that the City Manager can bring items to the City Council attention and to provide information about ongoing city activities.
