            SPECIAL EXCEPTION/Mike Ainbinder, MAD Men Ventures Inc., applicant/agent for the property owner, AJADS Investment Group, LLC.

            3510 S. Nova Road, commonly known as Tuscan Village Shoppes

 

            A request for approval of a Special Exception for a bar within the “CC” (Community Commercial) zoning district. If the special exception request is approved, the applicant, Mike Ainbinder, MAD Men Ventures Inc., is proposing to establish a sports bar on the premises.

6.            MORATORIUM EXTENSION/Pain Management Clinics

 

On January 18th, 2011 Council approved a 180-day moratorium relating to the issuance of development orders, building permits, and zoning approvals for business tax receipts for pain management clinics.  Staff is recommending the moratorium be extended an additional 180 days for staff to complete further research on these uses and to adopt an ordinance to amend the Land Development Code regarding the location and associated development requirements for pain management clinics.

7.            MORATORIUM EXTENSION/Internet Cafes, Game/Recreational Facilities, and Adult Arcade Amusement Centers

 

On January 18th, 2011 Council approved a 180-day moratorium relating to the on the issuance of development orders, building permits, and zoning approvals for business tax receipts for the operation of the subject businesses. Staff has prepared proposed changes to the Land Development Code and Code of Ordinances regarding the location and associated development requirements for these uses; however, in the event the proposed ordinances have not been adopted before the moratorium expiration date in July, Staff is recommending the moratorium be extended an additional 180 days or until a regulatory ordinance is adopted.

8.            Case No. 11-25000002

            LAND DEVELOPMENT CODE AMENDMENT/Chapters 2, 12, 17, and 18 LDC and Chapter 18, Code of Ordinances – Cyber Cafe

 

            An administrative request for approval to amend Chapters 2, 12, 17, and 18 of the Land Development Code (LDC) and Chapter 18 of the Code of Ordinances relating to Cyber Cafes. If approved, Cyber Cafes would be added as a special exception use within the “CC” (Community Commercial) and “ICD” (Interchange Commercial Development) zoning districts with accompanying regulatory requirements.

The Planning Commission shall limit the initial amount of time allotted for each applicant’s presentation to fifteen minutes.  The Commission Chairman shall apportion the time available for citizen participation on all agenda items.

 

The Commission will not hear new items after 8:00 p.m. unless authorized by a majority vote of the Commission members present.  Items, which have not been heard by 8:00 p.m., may be continued to a date and time certain, or to the next regularly scheduled meeting of the Planning Commission, as determined by affirmative votes of the majority of the Board Members present.

 

Any person who decides to appeal any decision made by the Planning Commission will need a record of the proceedings, and for such purpose he or she may need to ensure at his or her own expense for the taking and preparation of a verbatim record of all testimony and evidence of the proceedings upon which the appeal is to be based.
