The Planning Commission shall limit the initial amount of time allotted for each applicant’s presentation to fifteen minutes.  The Commission Chairman shall apportion the time available for citizen participation on all agenda items.


The Commission will not hear new items after 8:00 p.m. unless authorized by a majority vote of the Commission members present.  Items, which have not been heard by 8:00 p.m., may be continued to a date and time certain, or to the next regularly scheduled meeting of the Planning Commission, as determined by affirmative votes of the majority of the Board Members present.

VARIANCE/Arnulfo Simonac, owner/applicant

1152 Old Hammock Road (Commonly known as Country Manor ALF)


A request for approval of a variance from Chapter 6, Section 3(a) and Section 7(f) of the City of Port Orange Land Development Code (LDC) to allow a Certificate of Occupancy to be issued before all of the required site improvements have been inspected and accepted by the City. If the variance request is approved, Arnulfo Simondac, owner/applicant, would be allowed to open an assisted living facility prior to completing the remaining required site improvements, shown on the approved final site development plans, on a phased schedule. The timetable for completing the remaining site improvements would be detailed as conditions of the variance.

6.                  CASE NO. 07-65000007

REZONING/ Joe P. Calderwood & Gary Foleno, owners/applicants

Dunlawton Avenue


A request to rezone approximately 4.45 acres located on the southern edge of Dunlawton Avenue, just south of Causeway Park, from “GPU” (Government Public Use) to “PCD” (Planned Commercial Development) and to approve the Master Development Agreement and Conceptual Development Plan for the Intracoastal Oasis Marina Planned Commercial Development (PCD).  If approved, the PCD will provide the regulatory framework for the development of a 102-slip recreational marina along with associated infrastructure and stormwater improvements.

AMENDMENT TO THE CITY OF PORT ORANGE LAND DEVELOPMENT CODE (LDC)/Chapter 17, Section 30 – Planned Community – Port Orange Riverwalk (PC-R) District


An administrative request for approval to amend Chapter 17, Section 30 of the City of Port Orange Land Development Code (LDC) to provide for interim uses within the Planned Community-Port Orange Riverwalk (PC-R) zoning district.  The proposed zoning amendments provided the opportunity for publicly and privately held lands within the 35-acre Riverwalk Redevelopment Project Area to be used for short-term revenue generating business activities, as well as public and private special activities and events.
