EXECUTIVE ORDER NO. 17


AN EXECUTIVE ORDER OF THE NIMS INCIDENT

COMMANDER AND EMERGENCY MANAGEMENT

DIRECTOR OF THE CITY OF PORT ORANGE, VOLUSIA

COUNTY, FLORIDA, TEMPORARILY SUSPENDING THE

ENFORCEMENT OF THE USE OF RECREATIONAL

VEHICLES IN RESIDENTIAL AREAS; AND PROVIDING AN

EFFECTIVE DATE.


WHEREAS, Governor Ron Desantis issued Executive Order Number 20-52 on

March 9, 2020, declaring that a state of emergency exists in every county in the State of

Florida; and


WHEREAS, the City Council of the City of Port Orange has declared a Local State

of Emergency beginning March 16, 2020 at 7:00 p.m. pursuant to Resolution 20-12; and


WHEREAS, the Coronavirus (COVID-19) epidemic may cause life threatening

conditions for the residents of the City_ of Port Orange; and


WHEREAS, Governor Ron Desantis issued Executive Order Number 20-91, as

amended, requiring Floridians to stay at home unless engaged in acquiring or providing

essential services or engag’ed in essential activities; and


WHEREAS, businesses that provide essential services to our community continue

to operate and those service providers are often subjected to a heightened risk of

contracting COVID-19; and


WHEREAS, persons providing essential services may seek to self-quarantine

away from their families using a recreational vehicle (RV) for a residential purpose on

property that they own or rent in compliance with social distancing and quarantine

guidelines promulgated by the Center for Disease Control (CDC); and


WHEREAS, subsection (e) of section 70-48, Code of Ordinances, City of Port

Orange, prohibits the use of recreational vehicles or equipment for living, sleeping or

housekeeping purposes when parked or stored on a residential lot or in any location not

approved for such use; and


WHEREAS, due to the ongoing local state of emergency, leniency should be

exercised on Code Enforcement matters regarding persons providing essential services

seeking to quarantine in an RV on residential property, subject to the criteria specified

herein.


NOW THEREFORE, be it ordered by the NIMS Incident Commander and

Emergency Management Director of the City of Port Orange, Volusia County, Florida, as

follows:


SECTION 1. To facilitate the protection of health, safety and welfare of those

persons providing essential services, the enforcement of subparagraph (e) of Section 70-

48, Code of Ordinances, City of Port Orange, or rules substantially similar prohibiting the

use of RVs in a residential areas, is hereby temporarily suspended if a code enforcement

officer confirms the following criteria are present at the property:


A. The RV is parked in the driveway of the property; and


B. The person occupying the RV is either:


i. Employed as a person providing essential services; or


ii. Is a family member of the owner or tenant of the home when any

of these individuals are a person providing essential services;

and


C. There is a clear need to separate the occupant from the other

residents of the house to ensure all occupants are safe.


SECTION 2. This Executive Order shall become effective immediately.
