EXECUTIVE ORDER NO. 8

AN EXECUTIVE ORDER OF THE NIMS INCIDENT

COMMANDER AND EMERGENCY MANAGEMENT

DIRECTOR OF THE CITY OF PORT ORANGE, VOLUSIA

COUNTY, FLORIDA, TEMPORARILY SUSPENDING THE

ENFORCEMENT OF TEMPORARY SIGNAGE

RESTRICTIONS FOR RESTAURANTS; AND PROVIDING

AN EFFECTIVE DATE.


WHEREAS, Governor Ron Desantis issued Executive Order Number 20-52 on

March 9, 2020, declaring that a state of emergency exists in every county in the State of

Florida; and


WHEREAS, the City Council of the City of Port Orange has declared a Local State

of Emergency beginning March 16, 2020 at 7:00 p.m. pursuant to Resolution 20-12; and


WHEREAS, the Coronavirus (COVID-19) epidemic may cause life threatening

conditions for the residents of the City of Port Orange; and


WHEREAS, its in the best interests of the public health and safety for residents to

avoid large gatherings of people; and


WHEREAS, Governor Ron Desantis issued Executive Order Number 20-71

prohibiting on-premise food consumption, but continues to allow delivery and take-out

services; and


WHEREAS, the demand for take-out and delivery has increased as residents

continue to voluntarily isolate and quarantine in their homes; and


WHEREAS, temporary signage may be needed to inform the public which

businesses are open and direct the public to areas where take-out service is provided.


NOW THEREFORE, be it ordered by the NIMS Incident Commander and

Emergency Management Director of the City of Port Orange, Volusia County, Florida, as

follows:


SECTION 1. The City hereby temporarily suspends the enforcement of its

restrictions on temporary signage for restaurants advertising they are open for takeout

and delivery services. Temporary signage shall not be located within the rights-of-way, in

a manner restricting an accessible path under the Americans with Disabilities Act, or in a

manner that interferes with or impacts the safe passage of vehicular or pedestrian traffic.


SECTION 2. This Executive Order shall become effective immediately.
