  • The removal of trees damaged by fire, windstorm, lightning, or other acts of God, which pose imminent danger to life or property are exempt from the permitting and review process [unless the tree being removed is a historic tree (36” DBH) – historic trees are not exempt].
    • If there is a tree leaning towards a home or a tree hanging over a powerline, there may be an argument for imminent danger to life or property.
    • If a tree is already down, the tree removal permit would not apply for the removal of the downed tree.
    • If the tree was damaged (but not destroyed) and now poses an imminent danger to life or property, then the exception to the permit requirement would apply.
